Welcome to Growth OS. These Terms of Service ("Terms") govern your access to and use of the Growth OS platform, website, and related services (collectively, the "Service") operated by Arellano Global LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of the State of Florida, United States.
By accessing or using the Service, creating an account, or registering for any Growth OS plan, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.
By using the Service or registering for an account, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms in their entirety. If you are using the Service on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Growth OS provides AI-powered Instagram automation services including, but not limited to, automated outreach, conversational AI systems, lead generation, and appointment booking tools. The Service is offered through two tiers: Level 1 (Outreach System) and Level 2 (Full Automation Machine), each with distinct features and pricing as described on our website.
To use the Service, you must provide accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to notify us immediately at hey@growthos.to of any unauthorized access or security breach.
The Service operates on a subscription model with a one-time setup fee and recurring monthly charges. All prices are quoted in United States Dollars (USD). Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize recurring charges to your designated payment method until you cancel your subscription.
You may cancel your subscription at any time by contacting our support team at hey@growthos.to. Upon cancellation, your access to the Service will continue through the end of your current billing period. No partial refunds will be issued for unused portions of a billing cycle.
Refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference. Please review the Refund Policy at growthos.to/refund for complete details.
You agree to use the Service only for lawful purposes and in compliance with all applicable local, state, federal, and international laws and regulations, including Instagram's Terms of Use and Community Guidelines. You shall not use the Service to send spam, harass individuals, distribute malware, engage in fraudulent activity, or violate any third-party rights.
All content, software, technology, trademarks, and materials associated with Growth OS are the exclusive property of Arellano Global LLC. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
The Service may integrate with or rely on third-party platforms, including but not limited to Instagram, CRM systems, and calendar applications. We are not responsible for the availability, performance, or policies of any third-party service. Changes to third-party platforms may affect the functionality of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC RESULTS, LEAD VOLUMES, BOOKING RATES, OR REVENUE OUTCOMES FROM USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARELLANO GLOBAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Arellano Global LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
Prior to initiating any legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, either party may pursue resolution through binding arbitration administered in the State of Florida in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after the effective date of any modification constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
